Terms of Service

1. Agreement to Terms

By accessing or using the BST Bird Rehoming portal at birdrehoming.ca ("the Platform"), operated by Bird Sitting Toronto ("BST," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform. We reserve the right to update or modify these Terms at any time, and your continued use of the Platform constitutes acceptance of any changes.

2. Eligibility

To use the BST Bird Rehoming portal, you must be at least 18 years of age and legally capable of entering into binding agreements under the laws of Ontario, Canada. By submitting an application, waitlist registration, or rehome request, you represent that you meet these eligibility requirements and that all information you provide is truthful and accurate.

3. Account Responsibilities

When you submit information through the Platform, including applications, waitlist registrations, and rehome requests, you are responsible for ensuring the accuracy and completeness of all information provided. You agree not to impersonate another person, submit false or misleading information, or use the Platform for any unlawful purpose. BST reserves the right to reject, suspend, or remove any submission that violates these Terms or that we reasonably believe to be fraudulent or harmful.

4. Adoption Process

The BST Bird Rehoming adoption process consists of the following steps:

• Application submission: You submit an adoption application for a specific bird listed on the Platform. By submitting an application, you express genuine interest in providing a safe, loving home for the bird.
• AI chat evaluation: After submitting your application, you will be invited to complete an AI-powered chat interview. This conversational assessment evaluates your experience, home environment, and compatibility with the bird. The AI generates a score and recommendation based on your responses.
• Admin review and decision: A BST administrator reviews your application, the AI's assessment, and all relevant factors before making a final decision. BST reserves sole discretion in approving or rejecting any application. We are not obligated to provide detailed reasons for rejection.
• No guarantee of adoption: Submitting an application does not guarantee that you will be selected to adopt any bird. Multiple applicants may apply for the same bird, and BST will select the applicant we believe is the best fit.

5. Rehoming Your Bird

If you submit a request to rehome your bird through the Platform, you represent that you are the legal owner of the bird or have authorization from the owner to arrange rehoming. You agree to provide accurate information about the bird's health, temperament, care requirements, and history. BST reserves the right to decline any rehome request at our discretion. Once your bird is listed and an adopter is selected, you agree to cooperate in good faith to facilitate a smooth transition.

6. Content Ownership

By uploading photos, submitting application responses, or providing any other content through the Platform, you grant BST a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute that content in connection with operating and promoting the Platform and our rehoming services. This includes but is not limited to:

• Displaying bird photos on the Platform and on BST social media accounts
• Using application data to evaluate and process your adoption request
• Sharing AI chat transcripts with BST administrators for review purposes
• Featuring rehomed bird stories on our success stories page

You retain ownership of any original content you submit, but you acknowledge that BST may retain copies of your submissions for record-keeping and platform improvement purposes.

7. AI-Powered Features

The Platform uses artificial intelligence to assist in evaluating adoption applications through chat interviews and scoring. You acknowledge that AI-generated scores and recommendations are advisory tools used to assist BST administrators and do not constitute final decisions. All final adoption decisions are made by BST staff. BST is not responsible for any errors, biases, or limitations in the AI system's assessments.

8. Limitation of Liability

BST Bird Rehoming provides the Platform on an "as is" and "as available" basis. To the fullest extent permitted by law, BST disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. BST shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform, including but not limited to:

• Any injury, illness, or damage caused by an adopted bird
• Inaccurate information provided by bird owners or applicants
• Disputes between adopters and previous bird owners
• Any loss or damage resulting from reliance on AI-generated assessments
• Temporary or permanent unavailability of the Platform

You acknowledge that adopting or rehoming a bird involves inherent risks and that BST acts solely as a facilitator connecting birds with potential adopters. BST does not guarantee the health, temperament, or behavior of any bird listed on the Platform.

9. Prohibited Conduct

When using the Platform, you agree not to:

• Submit applications with false or misleading information
• Attempt to adopt birds for the purpose of resale, breeding, or any commercial use
• Harass, intimidate, or threaten BST staff, other applicants, or bird owners
• Interfere with the proper functioning of the Platform
• Use automated tools or scripts to interact with the Platform without authorization
• Violate any applicable local, provincial, or federal laws

10. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal information. By using the Platform, you consent to the practices described in our Privacy Policy.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario, Canada.

12. Termination

BST reserves the right to terminate or restrict your access to the Platform at any time, without notice, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination shall remain in effect.
